Article 1. Name
1.01. The name of the realm is Khador.
Article 2. Objectives and Purposes
2.01 The specific purposes and objectives of Khador include providing individuals the opportunity to safely participate in Belegarth Medieval Combat Society(BMCS), and to also promote growth of BMCS.
Article 3. Membership Requirements and Membership Benefits
3.01 Basic membership of the realm is and shall be open to all individuals at or over the age of fifteen and without regard to race, color, sex, lifestyle, religion, creed, physical abilities, sexual orientation, or national origin.
3.02 Basic membership in the realm is determined by attendance to no less then eight Khador sanctioned practices per year, must meet BMCS minimum-garb standard, must have a name to use within BMCS, and must have a signed waiver.
3.03 Paid membership of the realm is optional and open to anyone qualified for basic membership.
3.04 Paid membership has an yearly due of $5.
3.05 Benefits of paid membership include all benefits listed for basic membership, along with the right to speak and vote at meetings, vote in elections, and run and/or nominate a candidate for elections.
Article 4. Officers and Duties
4.01 An officer shall receive one of the following titles: Premier, Supreme Kommandant, or Kommandant.
4.02 No member under the age of eighteen (18) is permitted to hold an office.
4.03 No member shall hold more than one (1) office.
4.04 All Khador officers must have paid realm dues (described in Article 7) in Khador during their tenure as officer.
4.05 All Khador officers must have a good understanding of BMCS Book of War, the Khador Constitution, Khador realm rules, and must also have a good understanding of how to check weapons in accordance to BMCS Book of War and the standard weapon checking methods, besides meeting the requirements of a basic paid realm member.
4.06 The Officers of Khador shall be elected by a majority vote among paid voting members. (Voting process outlined in Article 6.)
4.07 The Premier shall call all meetings of the membership, regular or otherwise, and shall serve as chairman of such meetings. In addition, the Premier shall plan and coordinate Khador sponsored events as well as any realm voting sessions.
4.08 The Premier shall have final say in usage of Khador funds and other matters/issues within the realm with the exceptions of elections and voting.
4.09 The Premier shall keep all signed waivers on file. In addition, the Premier will also keep and provide blank waivers at Khador sanctioned meetings and events.
4.10 The Premier and one other person of the Premier’s choosing shall serve as speakers of Khador for any and all BMCS War Council meetings. This person does not have to be the same person for each and every meeting.
4.11 The Supreme Kommandant shall keep a record of attendance at all Khador sanctioned practices, events, and realm meetings. Should the Supreme Kommandant not be present at a practice, event, or meeting, this duty will be done by the Premier.
4.12 The Supreme Kommandant shall keep and maintain copies of this constitution and other main realm related articles such as the realm rules not listed in this constitution, and distribute said copies to the members of Khador upon request.
4.13 In the absence of the Premier, or should the Premier prove unable or unwilling to perform the duties described in all sections listed above, the Supreme Kommandant shall assume the responsibilities of the Premier.
4.14 The Kommandant shall be responsible for maintaining accurate financial records of Khador and shall be allowed to request disbursement of funds from the Premier.
4.15 All officers shall keep up-to-date copies of the BMCS Book of War and will distribute them to any member of Khador upon request.
4.16 All officers shall work to organize outer-realm events, such as BMCS demonstrations.
4.17 Any officer of Khador may resign at any time by delivering a written notice of such resignation to the Premier, or in if situation of the resignation of the Premier, said resignation shall be presented to the Supreme Kommandant.
Article 5. Meetings and Quorums
5.01 A quorum shall exist at any meeting of the membership where at least fifty-one percent (51%) of the paid members are in attendance.
5.02 Regular meetings of the realm shall be held once every four months at such a time and a place to be determined by the Premier.
5.03 A special meeting of the membership shall be called upon written request to the Premier by at least thirty percent (30%) of the members.
5.04 All members shall be notified of any meetings and to the nature of said meeting at least five (5) days prior to said scheduled meeting date. No meeting shall be called with the intent to exclude any one member or any portion of the realm.
5.05 In exception to 5.04, the Premier may call a private meeting of the officers and Kovniks for but not limited to reviewing Khador-related documentation, nominations for any trials, and/or the expulsion of any members.
Article 6. Elections and Voting
6.01 Public voting shall take place on a private, paid members thread on which only members who have paid dues by the last week of September shall be allowed to access. Members may pay dues after said date and will be paid, voting members upon doing so but will not be allowed to vote in an officer election nor be up for nomination or be able to nominate anyone else for election that year.
6.02 Only paid members can vote and/or be nominated and/or nominate others.
6.03 Candidates have the right to refuse nomination.
6.04 One nomination and one second are required in order for a candidate to run in an officer election.
6.05 Winner of an election shall be determined by a simple majority vote (51% of vote or higher). In situation of a tie, officers and active founders of the realm of Khador will be allowed to vote a second time, even if an officer is running for an office.
6.06 The officer election process shall be a three week long process beginning the Sunday after Oktoberfest. One week of nominations, one week of debates then one week of voting.
6.06a Officers will officially take their office directly following the conclusion of the elections.
6.07 Nominees must be an active paid member of the previous and current year of the election.
6.08 If a situation so calls for, any officer of Khador may be removed from office by a two-thirds (2/3) vote of paid members.
6.09 Any officer, if need be, may resign from office upon written form to be given to the Premier as stated in Article 4, Point 17. If, in such situation, the Premier chooses to resign, the Supreme Kommandant shall become Premier and an election for a new Supreme Kommandant shall be held at the next Khador sanctioned practice. In addition, the Kommandant may choose to step up as Supremem Kommandant, in which there shall then be an election for a new Kommandant. The Kommandant, however, does not have to become Surpreme Kommandant if the previous Supreme Kommandant is no longer in said office.
6.10 Changes to by-laws or alterations to the constitution will have two stages: Motion and Vote.
6.11 Issues motioned will be discussed via the private voting thread for one (1) week. If issue motioned receives one aye and one second, it will go to a one (1) week long vote.
Article 7. Realm Dues and Donations
7.01 Khador shall collect a yearly due of five (5) dollars (USD) from all members at the beginning of each year. Dues will continue to be collected throughout the fighting season. Upon paying dues and becoming a Paid Memeber, the member will be presented with a standard Khador belt flag.
7.02 This yearly due is completely optional to all members of Khador, with the exception of officers and Kovniks. All officers and Kovniks must pay dues yearly.
7.03 Dues must be paid before the first Sunday of October in order to be able to take part in officer elections. If dues are paid in the month of October on until the end of the calendar year, the member will be a paid member and will be able to vote at any meeting but will not be able to take part in officer elections.
7.04 Any additional money beyond the five dollars paid to the realm may be paid at any time and will be considered a donation to the realm, not dues. This, however is also completely optional to all members, Kovniks, and officers of the realm.
7.05 Money collected from realm dues and donations may be used for, but not limited to: materials for the construction of loaner equipment, materials for belt flags, and prizes for Khador sanctioned activities and tournaments.
7.06 No officer or member of Khador is permitted to use dues or donations for personal use or personal profit.
7.07 The Kommandant must produce documentation of all realm cash flow and spending at the request of the Premier.
7.08 All items in Article 7 apply to any and all money that comes into the realm, including that from Khador sanctioned events, tournaments, and/or donations from any and all members.
7.09 The benefits of paying dues are as follows: right to attend and speak at Khador realm meetings, the right to vote within the realm, and the right to nominate and be nominated for office. Upon paying dues, paid members are also now eligible for Khador realm trials which are discussed in greater detail in the Khador House Rules Appendix.
Article 8. Heralds
8.01 Realm officers have the right to determine who is and who is not a Herald.
8.02 Herald(s) and officers have the final say in which weapons are safe enough and who is and who is not allowed to attend practices.
8.03 Realm officers and/or Heralds must check all weapons at least once a month, in accordance to the BMCS standards and rules. If a fighter misses that practice, then all of their equipment must be checked at the next practice said fighter attends before they can fight.
8.04 A Herald must be a paid member of Khador or higher rank who has vast knowledge and understanding of the BMCS Book of War. In addition, all officers can serve as Heralds.
8.05 At least one (1) Herald shall be present on site during any battle.
8.06 Persons who are allowed to herald will be presented with a yellow tabard.
Article 9. Khador Sanctioned Practices
9.01 Khador sanctioned practices shall take place at least once a week, weather permitting during the fighting season.
9.02 Official practices must have an attendance of at least: one (1) officer, one (1) Herald, and five (5) members.
9.03 Any officer or Kovnik can arrange other Khador sanctioned practices outside of primary practice as long as it meets the guidelines listed above in 9.02.
9.04 All Khador sanctioned practices must keep an attendance sheet which will be submitting to the Supreme Kommandant at the closest convenient time.
9.05 A copy of the BMCS Book of War and the Khador Constitution shall be at each practice.
Article 10. Keeps of Khador
10.01 In order to establish and maintain a Keep of Khador, one must follow the following:
Practice location must be no closer than 30 miles from any current Khador practice
Practice location must be no closer than 20 miles from any other current BMCS established realm practice.
Must have a minimum of at least five (5) members.
Must have at least two (2) practices a month, weather permitted.
10.02 Leader of Keep:
Must be a paid, flag wearing member of Khador or higher
Must operate the Keep in a similar fashion to Khador
Shall be given the title of Kaptain
10.03 Keeps of Khador may not be called Khador or share a name of any other recognized BMCS realm or unit.
10.04 This constitution, in all forms, applies to any and all Keeps of Khador.
10.05 If need be, such as Keep not following Khador requirements and rules, Khador has the right to pull the Keep by two-thirds (2/3) vote.
Article 11. Constitutional Related Miscellaneous
11.01 This constitution may be amended or repealed by two-thirds (2/3) majority vote by paid members.
11.02 Additions or revisions may be made to this constitution by two-thirds (2/3) majority vote by paid members.
11.03 Any amendment or revision will be made and put into effect immediately.
11.04 This constitution and any amendments or changes to it shall be kept on record and made available to any member of Khador upon request.
11.05 Any member of Khador may request a physical copy of this constitution at any time from any current active officer.
11.06 An online copy of this constitution shall be made public to all members of the realm.
